Privacy Policy

We are Exploria, a playful game application where users engage in a digital treasure hunt.

This policy (hereafter “Privacy Policy”) explains how we collect, use, share and protect personal data within our application. We undertake to build the game and any of its features in such a way that it respects your privacy as a user and allows you to understand what we do with your personal data.

By using our application, you understand that we are providing a platform for you to collect checkpoints.

We protect children’s integrity. Therefore, we do not intentionally process personal data relating to children under the age of 13 without their parental approval.

Our Privacy Policy applies to all users.

1. INFORMATION WE COLLECT

We collect the following personal data:

Users can take pictures with the device camera to scan a QR-code. These pictures will not be uploaded on the application, stored remotely or shared with third parties.

We may use information that we receive (including personal data) for the following purposes:

We will not process your personal data in a way that is incompatible with the purposes for which it has been collected or collect any personal data that is not required for the mentioned purposes.

The processing of your personal data can be based on the necessity to fulfill the agreement entered into with you, namely to enable you as a user to make use of the application and participate in the game.

We may also process your personal data based on our legitimate interest to enable us to provide you with good service and to prevent illicit use and fraud.

In case of marketing purposes, we may also process your personal data based on your explicit consent.

4. SHARING OF YOUR PERSONAL DATA

The number of people who have access to your personal data is limited. Only people with us who need to process your personal data in accordance with the purposes stated above have access to the personal data. We will not rent or sell your personal data to third parties.

We may share your personal data with suppliers and partners who perform services on our behalf or who in other ways co-operate with us, including our fraud protection services, our payment service providers, our business system provider, our website host supplier and our implementation partner. Such partners will in principle be located within the EU/EEA but if they are not we will comply with the relevant requirements with respect to international data transfers.

Your personal data will in principle not be transferred to countries outside of the EU/EEA. When your personal data is shared with countries outside the EU/EEA, we use standard contractual clauses that have been approved by the European Commission as well as supplementary measures necessary to ensure an adequate level of protection for your personal data.

What happens in the event of a change of control? If we sell or otherwise transfer part or the whole of Exploria or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your personal data and any other information collected through the application may be among the items sold or transferred.

Responding to legal requests and preventing harm. We may access, preserve and share your personal data in response to a legal request (like a search warrant, court order or subpoena) or if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of Belgium where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share personal data when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm.

5. HOW WE STORE, PROCESS AND TRANSFER YOUR PERSONAL DATA

We process your personal data in a way that is compatible with and relevant for the purpose for which it was collected. To the extent necessary for those purposes, we take reasonable and appropriate steps to ensure that any information in our care is accurate, complete, current and reliable for its intended use. Except for the email address, no other information will be used for later promotional purposes in accordance with the applicable data protection legislation.

All information that you provide to us through the application is automatically uploaded to our servers and is stored there in duplicate to the information stored on your device.

We will process and store your personal data as long as needed for the above purposes, taking into account the applicable statutory retention periods and statute of limitations. Except for your name and email address, your personal data will be deleted 1 month after the end of the game. Your name and email address will be deleted after 1 year after the end of the game. Thereafter, you will be asked annually whether or not you wish that we continue the processing of your personal data in accordance with the above. If you do not wish continued processing or if you do not answer the request within the time frame stated in the request, your personal data will be deleted.

6. WHAT ARE YOUR RIGHTS?

With regard to the processing of your personal data by us, you have the following rights:

7. CHANGES TO OUR PRIVACY POLICY

Exploria may modify or update this Privacy Policy from time to time, so please review it periodically. We may provide you additional forms of notice of modifications or updates as appropriate under the circumstances. Your continued use of Exploria or the application after any modification to this Privacy Policy will constitute your acceptance of such modification. In some cases, we may require you to expressly accept new Privacy Policy in order to continue using our application (for example if we expand types of personal data collected from you or introduce new purposes of collection and processing).
